if you think it cant be done or it is wrong then dont try. if you got a problems with other people trying then pm them, not me.

wow, because of a shot load of PM's here:

it must be done over the phone, not walk in.
you must VERY polite, but very firm and come across unhappy/bummed out/frustrated
you call cellphone insurance company that u use.
get through the robot voices
when u get to a human it will be a level 1 customer support.
they will tell u their name. refer to them by name throughout the process. this will make the conversation more personal and they will have greater sympathy for u.
tell them that ur phone isnt working how it is supposed to.
tell them it is constantly turning itself off, dropping call, just weird stuff. (dont say too much, dont say things like, the ear piece is broken or the screen is blurry, make it sound like it is internal manufacturing defect or something)

tell them that u got this phone for business use and it has been nothing but trouble.
they will say that they will send u a replacement mogul/titan/6800.
say "uhhh...ok.....well is there something else i can get that will work better frank?"
they will say no or that u can get a palm or a blackberry or something.
say "I know that there is a new version of this phone that is out. i need that frank.'
they will say NO, yes, or hold on a sec. (meaning they are getting supervisor)
if u cant get it from them then u say "hey frank, could i speak to ur supervisor please?"
they WILL put u on hold for 10 mins or so. so call from a land line
when u get the supervisor tell them the same sob story. refer to them by name throughout!
tell them the work u do demands that u have a phone that works well.
tell them that you want to stay with the carrier you have but will do whatever it takes to get a phone that works (implying that u will change carriers)
be smart about it, just dont take no for an answer, they will not hang up on u. DONT U HANG UP! if u are polite they arent allowed to hang up on u. just keep at it. they have boxes of the new phone right in their warehouse so dont let them tell u that they dont have any.
if after 10 minutes of trying to get it from the supervisor and u cant get it. wait a couple of hours and call back again. this will work. if u cant get it from them then ur not smooth enough and probably a better worker then me and can afford it.

my quotes are structured in a specific way. you always want to say their name at the end of a sentence. or end a sentence with a positive word like please, thanks, things like that.

As far as turning in ur mogul you are looking at only getting about $30-50 of ur bill. Ur best bet is to just sell it on ebay... (And be for u as a stupid question like how much will i get for it on ebay how about u take a look for yourself)

what shoes do you pay a monthly insurance for?? think before you talk.

Ever heard of lemon laws? many states have them. if you have to have something fixed 3 times then u are entitled to a replacement. now i know this doesnt mean an upgrade, and that they usually just replace them rather then fix. but the point is that there are consumer protection laws out there.

Well sorry to break you guys bubble....All the ones that said you cant swap a phone for free at a store....Well i did... went from a ppc 6700 to a mogul (may i say my ppc6700 was all F* up) to a touch 6900 for free (all less then two months apart)....NOTHING... NO CONTRACT no MONEY... Soo how did i get it you may ask...I have two friends working in sprint and may i add that i did not know them from before and they did me that favor....I built a friendship with them in the sprint store and violla!!..It all depends on who takes care of you IN THE STORE.. IF they want to be a **** they could..BUT IT IS possible. Now im waiting till the middle or the end of october to change my TOUCH to a Diamond....FOR FREEEEEEEE......

I'll definately give this a whirl in a few months with the touch pro's are out. Seems like it can't hurt to try the store either. Thanks for the advice!

Just did this with a buddy on VZW. The store shut him down and the insurance company shut him down. But then we just picked up the phone and took turns calling service reps at VZW till we found one that actually offered to authorize it and then call the store to make sure it went through well.

He went from a 5 year old smartphone (older than a treo 650) to last years samsung i760.

Not bad! So its possible.
