If this guys a fraud its likely something along the lines of a hacked account...which I believe eBay has some forms of restitution to. Its hard to imagine he's got this feedback and suddenly goes bad

Exactly my thoughts..
That's the only reason I even toyed with the idea of trying in the first place.

I know similar questions have been asked, but will Sprint allow my $7 insurance/warranty plan on this new Touch if I were to activate it? Speaking of activation, do I still have to call in to Sprint to activate an eBay'd phone?

Insurance should be no problem at all, and of course you have to call Sprint for activation.

Except for the 2 super recent negatives, his feedback is soooooo outstanding, looks like the perfect seller, I would buy from him in a second if I had too.

See his slogan "I bleed yellow and black", one of you buyers need to email and ask him where the phones are coming from, those prices are just incredible.(Probably a secret though, maybe the seller is even Sprint themselves, Dell does it or ar least used to)

lol eek I couldn't wait. I purchased one from him for $225, so $240 total. Pretty nice for a new (and assuming no-fraud) Touch without dealing with Sprint and tax! I guess I'll try it out for a week and decide whether I'll sell my Mogul. Thanks for your replies too guys - good thing the two answers are "positive" since I bought it after I posted!

Oh and the minimum offer he's allowing is $225. I tried $220 with auto-decline. He'll most likely relist more now.

Unlock...it...? What are you referring to? The GSM version? The Sprint/CDMA version? ImCoKeMaN made an "unlocker" for the Mogul and seems like he just released one for the Touch as well.
