Good point. Also, if there is a USPS return envelope do they expect you to send a defective unit back? Don't they charge your account if you get a replacement and don't send the old unit back?

The ebay kid doesn't have my Sprint # to have used during the transaction, so there's no way they could charge me for it.

most people don't realize they don't have to have your sprint #, just the esn. once they input the esn they can pull up your acct from there. if they find a stolen esn on your acct either they can direct bill you for it or try to get you to reurn the phone

Gentlemen, let's be civilized here. If this does happen, we do what we Americans do best, sue the hell outta him.

Okay I kid, but a class action or petty claims would work I think.

That may work. Hell, we don't "know" they are illegal right?

But that is correct, he doesn't have to have your Sprint #, all you have to do is activate that phone and they will notice the ESN is blacklisted.

*BUT* He does state clearly in the auction *CLEAN ESN*...

Guys, he's been doing this since July - I doubt very seriously this bunch of phones is any different that the hundreds he's already sold. And he certainly would have been shut down by now if all of those ESN's were blacklisted. - sheureka

The package came directly from Sprint, and it appears that he has someone on the inside of Sprint sending out EPP replacement units to his ebay winners. So, whether this is a refurb unit or not, I'm not sure. It would assume that they don't have any refurb units of the Touch yet to send out, but I'd love to find out a way to see if this is a refurb. There are no indications to say that it is a refurb.

The packing slip shows that mine shipped on 11/28, which was 5 business days (within his allotted time on his ebay description).
Can we assume you had no problem activating this phone?

In fact he has NOTHING for sale now.
