Refurbished or New phone purchased on Ebay???

Using your phone dialer if you type in ##786# the phone will show if it was refurbished or new. And yes I have eneded up with a refurbished one when the seller clearly said it was new. My question was does anyone know if these settings could be hacked in? IE are there ebay sellers out there that could hack and change these setting?
