Yeah and it doesn't matter how many times we say this or how you word it, some people still think it means all you have to do is just "know" you are recording. lol Far from the truth.
While a moderator of a large divorce firm website I have had to correct this quite a number of times.
Also, in the instance that the recording is legal, it can in fact be used as evidence in court. However, it is up to the judge to determine the weight of the evidence. Many times it's used as leverage before the trial, therefore sometimes not even needed to present to the court.

If you record something illegal then "sometimes" it can bypass the recording laws and you can not be held accountable. Odd as that may seem. So if someone is threatening to kill you chances are good that a recording will at minimal assist you in getting a restraining order...even though the recording itself wasn't legal.

Also, the given guidelines are not perfect, nor set in stone, as it gets mixed when calls are made between differing states and judges have discretion on many things.

But in the end, as long as you don't allow it in hands of anyone that has any remote chance of prosecuting or attempt to use it as blackmail then you should be alright.

I find recordings good for getting directions..seems half the time I think I wrote it down wrong when it turns out they just gave it wrong.

Also good for when the Sprint people tell you something that you need to ensure is honest.

And one last thing, any message left on your voicemail anywhere is always legal and submissible in court, as they knew they were being recorded of course.

Now if someone would just post a link to a cab file that they have actually tried and confirmed to record both sides without the use of speakerphone that would be great.
If not, we'll just have to wait and hope that the software can be ported over from the TouchHD which is rumored to have this ability.

1. I'm able to make great recordings both with the recording tool in the notes and with the voice recorder. However, neither will record for very long. Is there a way to hack the length that they will record, maybe with a regedit?

2. Don't be too sure that recording your conversation with Sprint means they will do what they promised. I had a rep promise I would be charged $250 before rebate on my HTC . I have a clear recording of this. My bill showed up and I was charged much more. I called in and was told nothing could be done b/c it wasn't in the notes. I asked where to send the recording for proof. A supervisor was asked and responded that they wouldn't even listen to the recording "because recordings can be faked."

So, voice recordings are good enough for the Court of Law, but not the Court of Sprint. (I have feeling the recording will be good enough for my credit card company when I dispute the charges, though.)

You need to call back, or email eCare and tell them the situation. Tell them you HAVE a recording. Keep escalating it.

yes and if any further clarification is needed on legal rights etc it can be found all over the internet... It is the Electronics Communications Privacy Act. Paraphrasing the law gets people into trouble if something is left out or not detailed in entirety.
Recordings generally don't hold a lot of weight in court but can generate tremendous pressure on people to be honest or work out settlements so it doesn't have to be used in the courtroom.

Thanks. I actually called back 5 minutes ago and lucked out with a rep who could ACTUALLY READ THE NOTES! $200 plus tax has just been credited back. Oh, and I used the notes app to record her confirming this.

Still, I'm wondering if there's a way to get the notes app to record more than just ~30 seconds. Anybody?

So, using the HTC Touch Pro, and just the Notes application, you are able to record both sides of the conversation, without using the speakerphone? (For 30 seconds?)

Actually, I was using the speaker phone. I haven't tried it without speakerphone, because it's easier to use access the recorder buttons and such if I don't have the phone against my head...

But other than that, yes: HTC Touch Pro, Notes Application, both sides.
