thats basically what im asking.

i remember years ago you could add a line of service to your cingular account, get a new phone with a big rebate, cancel the new line of service, and just use the new phone on your old number. cingular never asked for the phone to be returned, and never tried to charge you for it later.

im wondering if this loophole exists with sprint as well. if it does, than thats obviously how the ebay seller got the phone. if it doesnt, than maybe the seller fraudulently did this on somebody elses account, and they will find out about this later on when sprint asks for their phone back or issues a chargeback.

As far as I know, if you cancel the line within the first 30 days, you return all equipment, do not pay the ETF, and just pay for the prorated amount for your usage. If you cancel it afterwards, you keep the equipment, pay the ETF and other charges.

guys what do you make of this....

im browsing through the ebay sellers feedback and his store(99% positive feedback, over 3000 feedbacks), and among the hundreds of phones he has sold, there are a few listed as BAD ESN.... could it be all the phones listed as bad esn are items that he sold to people as clean(which they were at the time), they were used for a while, then sprint bricked the phones later when discovered the phones werent kosher?

Sprint may be supplying the guy with phones knowingly... Or the guy could be running a huge scam. More often than not though, if he is selling THAT MANY phones, then he has worked out a deal with somebody and the deals are legit. He is either an affiliate seller making a few bucks per sale for a larger vendor or he has his own contract with a distributor. No different than a guy selling phones at a mall kiosk. The profit margins ar likely slim and he deals in volume to be profitable.
