the only ROM i have is this one.

and my 30days was up 2days ago. so ill uninstall taht then try those links the other guy put up. but just in case would i have to delete the roms before taking it into the store? i havent messed with anything that doesnt look like it would be modded except for removing a few of the tab options

That is not a ROM, that's just a cab. So you could take it to a store just like that and be fine. Following the instructions and installing those other links will fix your problem though. Your phone will be better than ever.

Take that sucker back for an exchange. You just got unlucky and got a faulty unit. This phone is way better then your prior phone.

what if mine has a nice 3cm scratch that you can feel with your nail? and a scuff on the corner? would it still be a software issue? since i never have problems with power or anything?

Yes. Everyone drops their phone at some point and the screens on these are scratch magnets if you don't use the screen protector.

Just follow those instruction by installing those links and you'll have a nice new phone.

I absolutely agree. You should take the phone back. Even if you are outside of your 30 days, sounds like manufacturer defects to me. Especially the failing proximity sensor while on the phone, mine works incredibly well.
