was having the same problem until I reflashed with 3.35 sprint ROM. The way I solved it was soft reset every morning. The reflash fixed it.

Had it happen a couple of times.. this is what i discovered. Would actually catch myself looking at the phone the moment someone was calling and no ringtone eventho the volume is all the way up.. used the wheel to turn up more and no joy.. Then went to resco radio which i use alot and tried to see if i can hear music from there.. tuned in a station and using the wheel i found that the volume was down to zero .. i had done that playing poker at a casino with headphones and just turned it up and volume was returned to radio and to ringer.. wierd.. thought mogul volume was universal on all apps and associations.. guess not
