I just got off the phone with Assurion, sprint customer service and account services! if you are waiting for a replacement mogule, your wait will be a long one. there are 2000 on back order and there is no definite shipping date, so if you were told 7-10 days like I was, you were lied to. I view this as a breach of contract on sprint and assurion's part. if you are waiting for one you need to call in asap and start B****ing. I have been on the phone for the past 4 hours with Sprint and Assurion and am still getting the runaround!!! stand up and be heard or lay down and be screwed

yea,they should defintely should offer the next like model,which would be either a Touch or Diamond (im pretty sure they wouldnt offer a TP) but they should offer you something since 7-10 days is an unexcusable wait time for an insurance replacement.

no,no. the wait is now indefinite! they can't say when they will get any in or if they will get any in... so if you were told 7-10 days, you were lied to...

Glad I checked on here. I was going to ask you insiders what I should do, so if you have any suggestions, please post them!

I lost my Mogul very, very SAD) just before Christmas. I called into Assurion (is that pronounced *** your on??) on the 29th to place my claim for a replacement. They assured me that it would be 7-10 days, just like the OP. Welcome to day 10. No phone.
I called assurion last night, the rep told me not to worry that I would receive my phone, just a computer glitch. When I didnt get it today I went to the local Sprit store and had the manager there call assurion for me. He told them that if they didnt have the Mogul, they should get me an equilavent model. That didnt happen.
I am about to call Sprint on the phone and start complaining there too. I want another Mogul, but I am NOT willing to wait an undetermined amount of time to get one. Assurion has taken my money for insurance for a year and I expect better service.

my mogul is broken. i called asurion to see what could be done for me... they told me about the backorder... and offered me an HTC 6900 Touch. I normally wouldn't mind... But for a person who send and receives email and text messages non stop... this is not a good option. damn sprint for their back orders. they should at least offer something worthy.

Rant continues...

So, got off the phone after complaining to Sprint and they switched me over to Assurion,,,grrrrr.

Spoke to a nice rep who also stated that the Mogul was indeed on backorder and that there was no information on when the mogul would become available to ship out,,,grrrrr.

The rep did offer 2 choices instead of the Mogul. The Touch, or the Touch Diamond. I said absolutely not for the Touch, no slid out keyboard for one. I know that is also an issue on the Diamond but have not played with the Diamond at all to see if that would be an ok substitute. In the past Assurion offered the Touch Pro but there were so many customers choosing that phone that it too is on back order,,,grrrr

So, what to do. Wait for a Mogul, take the Diamond, or call Sprint back and continue my rant until I receive some satisfaction. I believe that I could be happy with the Touch Pro, because I love the slide out keyboard (TM junkie here), not too sure about the Diamond.

I guess its time to go over and read about the Diamond on this site to get some user input before deciding.

Any other input would be GREATLY appreciated!!!](*,)

I too ordered a replacement phone for my broken mogul. I ordered it on the 20th of Dec and was told about the backorder. However, I did receive a refurbished mogul on Jan. 5 (phone, battery and stylus)

:disgust: Well here is what I have decided to do.

I am waaaaayyyy too impatient to wait for weeks to get a refurb Mogul, as attached to that phone as I was. After reading a lot about the Touch Diamond, the only two drawbacks that I can see are the lack of sliding keyboard, and the lack of additional storage capacity (4GB internal only).

That being said, it looks and feels like a nice phone and has a good form factor. I see there are apps that I can load that will limit the keyboard shortcoming by giving a reasonable touchscreen keypad. Since my only option is to choose the diamond or wait as eternity, I will choose the diamond.

I hope that I do not regret it

I hope all goes well fo you. I however need the slide out keyboard [im a TM junkie too] not to mention I have "fat" thumbs!!... there hosing us on this by giving out a downgraded model. for my two cents worth its the TP or I take my business over to Verison!!!

im sorry if i missed this part, but when you say moguls are indefinately backordered, does that mean refubs also? Personally, i'd take a refub mogul over a diamond just because of the storage limitations on the diamond. Memory cards are a must for me. keyboard, i could go either way.
And no wifi on the touch is also a big negative.

Now this thread has me worried...

I was told the 7-10 days when I filed my claim with Assurion on Tuesday, but a phone was shipped out the same day. The phone, whatever it is, awaits me in Philadelphia (not in the US at the moment).

I requested the Mogul... So I wonder if I somehow got the last Mogul or if they gave me an automatic change to the Diamond or Touch...

yes that means refurbs too (in fact that's all you get from assurion)

Get the Diamond. Install TouchPal. It's the SIP that broke me away from the hardware keyboard and I don't miss the bulk of a brick. Get Tochpal here:http://www.cootek.com/

sorry to say this gentlemen but i went to replace my mogul and she said it was on back order too. but she went in the computer and ordered me a touch pro and it came in in 2 days. try going into a sprint and complaining. worked for me.

i just posted this 2 days ago....

long story short.. Sprint paid 119.86 my monthly statement, due to the fact i raised hell cuz they wanted me to wait 7-10 days for a replacment mogul.. and even the the Touch Pro is on same back order, they threw me on the waiting list instead of the MOguls supposedly..

so 1 call... 119.86 credit, plus a Touch Pro is 7-10days.......

i assure you, if no phone in 7-10days, itll get a diamond every 7-10days for all my other lines, and ill still wait...they can keep paying my bills too... i have 3 lines maxed out,eligible for 5, have unlimited credit cap43% in discounts, been with sprint 8 yrs, never missed a payment... i ***** they listen lol

well here's some new B.S. now Sprint Is threatening to cancel my Acct. and this after I spoke with an escalation person who was the rudest person iv ever delt with at sprint. I called back and was asked is If I was ready to "cancel my service" they were even ready to let me out without paying the $200 per line cancelation fee!!... aint that some S**T......

Wow that sucks boubert. Ask to speak to Retentions. I'm surprised you are getting this kind of crap really because Sprint has been doing a lot better from the reports I've been getting recently. Maybe you should wait until tomorrow.

Also it's pronounced A-sure-ion. I hope that helps.

Well I went to the dealer here to get my Mogul fixed, turned out they couldn't fix it, wouldn't give me a replacement, said there was no phone that they were allowed to swap out with. Told me to give asurion a call. Well I did and they said the Mogul was on backorder, but they would send me a refurb in 7 to 10 days. Well I got it in about 5 days, thing looks brand new too. I was really hoping to get it swapped for the Touch Pro, but you know what, I'm okay keeping this phone now, cause I think I really want the Palm Pre when it comes out now.

Listen, if they are out of stock then they are out of stock. *****ing to sprint is not gonna make Moguls appear in their hands. I personally would have takin the diamond ANYDAY over my mogul. Mostly for the RAM. But, if you wanna complain to sprint for them to ship a phone they don't have, be my guest.

I agree with hibby. I called them because my screen broke on my mogul and they are sending me a NIB Diamond. Should I keep it or sell it and get a Touch Pro???? I really hate the fact that the Diamond does not have an SD Slot, KEYBOARD, or Flash for the camera. It kinda annoys me. can the internal storage be used as a flash dtorage or do you always have to activesync it????

well I am taking the pos diamond because I need a phone asap!! im not happy about this but im tired of banging my head aginst a wall. I guess this is my biggest problem "you will be shipped the same or comparable equipment of like kind and quality with similar features and functions to your original equipment" can someone explain to me how the Touch Diamond is the same as my mogul??? other than they both run Windows Mobile there is no further comparison, No slide out keyboard, and No external storage! they keep telling me "but the Diamond has 4 gigs of internal storage" I have an 8 gig card in my mogul right now! the fact is the Touch/Diamond were designed as HTC's answer to the I-Phone! and I wouldn't own an I-Phone, so why would I want HTC'S I-Phone knock off??? sour grapes. im leaving home for about 8 weeks and when I get home ill be switching cell phone companies!!!!

What a nightmare. The only thing I can contribute is to try another Sprint store. I have two near me and if I do not like the answer I get from one I go to the other.

I am going to take good care of my Mogul... I also have $100+ invested in my Proclip car mount.

i called asurion about my mogul and they offered me the same thing touch or diamond. i told the lady that i needed a keyboard and she put me on hold and when she came back on she told me that she could give me a treo 800. i asked why they wont give me a touch pro and she said they can only swap for the same type of phone i.e. diamond or touch... wtf those two are not comparable so im thinking about going in to a store and see if i get better luck there

Anyone who would take the mogul over the touch diamond needs there head examined. I was waiting for the pro and since it's always out of stock, I took the diamond this week thinking i might send it back when the pro comes in. Now after having the diamond a week. I will never get the pro. The pro is too thick and i don't text enough to need a keyboard. Take the diamond. It Is Balla Status For Real. By the way anyone want to get the diamond and trade it for a great mogul which i am about to put on ebay pm me. They just don't have enough memory, other than that they are great phones. Mine was anyway. The pro is a brick. --- active sync will solve your sd problem if 4gb is enough for you. Sure tv out is nice but bang for the buck and size Diamond is where it is at!!!

I'm also waiting on another mogul to come in. I went in to get my mogul looked at in late december and was told a week for another mogul. Here we are on the 11th and I still dont have a working phone. I also called asurion and was told touch or diamond. Hopefully if we just wait it out a bit longer, we'll be able to go to the pro.

Its not really that its unreliable, its that the phone has some limitations and smaller defects that have been addressed in the touch pro. Among other things anyway...

If you are completely without a phone, I feel for ya. I had some water damage to mine and initially, it seemed to only take out the wifi hardware switch. I lived with it for a while since I have a cooked rom with a software wi-fi switch. Phone started going into airplane mode & wifi would come on by itself. It was time to make a claim. I did just that in the early early AM on 22 Dec.

You guys know the rest. I made a few calls and emails to Asurion as well. I was offered a Touch Diamond or the Treo 800W. I declined and countered with a request for a Touch Pro. They told me they aren't able to do that model as a replacement so I agreed to wait for a Mogul. Days pass.

While I am waiting, I find a can't-pass-up deal on craigslist for a NIB TP. I get a hold of the guy and we make the deal the next morning. Yay. I now have a Pro. I get it activated and I immediately miss my Mogul. The navigation button is a downgrade from the 5-way I know and love. I miss the buttons for messaging, browser, comm manager, camera and flashlight. The softkeys and start menu button are also sorely missed. I hoped I would get used to doing things differently but guess what.
Late that same afternoon, 9 Jan, my replacement Mogul shows up. Oh, thank you! It's a refurb, but I don't care. The Touch Pro is sitting on my desk being ignored until I spot a custom rom that might make me want to use it.

The refurb has some issues and I swapped parts with my old phone to fix it. It arrived with a bad white spot and really crappy touch screen sensitivity. I found the camera was showing over a dozen bad pixels too. I kept the screen & camera from my old Mogul - they were still like new. Old one goes back in the mail to those devils on Monday.

Hope those who are waiting for a replacement Mogul get taken care of soon. I think I might start hunting for a spare. I love this 6800 so much more than the 6850. For those fighting to get a Pro, be careful what you wish for. It's faster, but there's a tradeoff.

"*****ING" works..They told me it will be 7-10 business days til i can get another one...I told dem "BULL****"..So i did alot of calling an talking well i guess they got tired of me because the`next day i had a BRAND NEW MOGUL in the box...so *****ing works...

Just wanted to say thank you for the post. Heh, I know my titan is now at EOL (end of life) and the lack of development made me do this. I was able to get a Touch Pro free upgrade. I called into sprint customer care and told them I have white spots on the screen and the keyboard every couple of days stops working. I have to soft reset to make it work. I went on to say I hard reset the phone and also flashed to the latest rom and also hard reset after I flashed it and I still have the same issues. The sprint customer care rep gave me an eticket number and said to go to the local sprint store and they will resolve it. So I went down to my local sprint store, sure enough, there are no titans available in the warehouse and the store did not have any. They offered me an free upgrade to a Touch Pro and I took it. So that is my story, maybe you can pull it off stating something similar or even the same, just don't mention, Mikee4fun. =P

tomorrow morning I am calling the colorado states attorney general. this is a breach of contract! there TEP policy states the phone will be replaced with the same model or like kind with similar features. the diamond and the titan do not have the same or even similar features, other than they both have a windows mobile os. I personaly don't care about "storage memory" I have sd cards coming out my arse!!! maby that's why im sooooo grumpy about this...lol. im not taking this lying down, and am not through raising hell with them. " I have only begun to be a pain in the butt customer" its not the phone as much as, there not holding to there own claims! to replace my phone with a phone of equal ability.... oh well tomorrow is another day and im sure I won't get the same customer service rep....

I can guarantee that there is either a clause in the contract which covers them in this kind of situation, or that "similar features" is broad enough to cover the diamond. In any case, a CBA would indicate that it's likely not worthwhile to initiate any legal action against Sprint for this...
