well if you want to go legal read the fine print.
they have 30 days
arbiration required (legal action can be taken in some states if you don't like the arbitration results.)

The replacement would have to be comparable to the item thats to be replaced. the touch dosnt have a slide out keyboard and i believe the diamond dosnt either as well as the fact theres no slot for memory card. After talking to her manager she confirmed that since the toshiba wasnt a clam type phone they would have to send her the next closest thing which at the time was the 6600.

I'm sending them my problem-filled Mogul this morning. Chances are, you'll get a refurb once they turn some of these around. Hopefully very soon.

Why would legal action be not worthwhile? You can initiate an arbritration claim against Assurion without a problem. Assurion will advance the arbritration administration fee and you may only have to come up with a small fee.

The arbitration fee isn't the only cost of the proceeding. Plus, for $175 you can get a new or nearly new Mogul from Craigslist or something...

Well I have been waiting almost three weeks for a mogul from the sprint store, and the manager gave me a $20 dollar discount, I tried calling ausrion but all they are offering is the diamond, touch 6900, and treo 6800, but I have to pay $50 dollars as a deductible which makes know sense because I usually dont have to pay anything to replace any other mogul because I have the total equipment protection plan... but any advice?

The $175 fee is the only fee you're liable for (and only if paying it won't cause you economic hardship) the rest is put up by Assurion (read the contract I linked to...)

If you win you're not out the $175...

Also. You can do whatever option you want. You can buy one on eBay, Craigslist, accept the Diamon, whatever you feel is the option for your stomach. I posted this info because some people were talking about it being hard to sue.

Arbitration is a lot easier than court and the decisions are from independent arbritrators. So if you feel they really are violating the terms then you can, for very little upfront, bring action against them.

So you could have the aribritator order them to give you a TP, a refund on all premiums, etc...

But I'm just giving information so do whatever meets your comfort level.

What is wrong with this Mogul that you are going through insurance?

I hate to post this here but noticed a lot of you were wanting a titan instead of the diamond or touch assurion is offering. If anyone wants to trade a diamond for my old sprint titan (got a touch pro) PM me. Sorry to post here did not have enough posts for bargain trader.

well here's the score card for this morning.... I am reciving two Touch Diamond's, one from Assurion one from sprint, $120.00 in credits, and free activation on both phones. also next day shipping on both phones at no extra charge. so as it has been said earlier B****ing has its benefits... now im sure I will hate the I Phone wanna be's im getting but ill deal with them till mid to late february when I leave Sprint altogether. so at the first part of march I may have two Diamond's for sale!... good luck all
