if you get your phone replace 3 times under the tep insurance will sprint let you upgrade your phone thanks

No. TEP entitles you to have your phone replaced with the same (or similar) model only. If they have your model in stock, you will get it as the replacement. If not, they will offer you a "similar" model. The only time you can get your phone "upgraded" is if you take it to a repair center and they are out of your model and have no "similar" models.
Right now, if they are out of Moguls, a repair center would probably offer you an 800w or Touch Pro, since they are the only WM6.1 phones Sprint has with a keyboard and touch screen. If you have had to have your phone replaced so many times, retentions may offer to swap you for an upgraded phone, but that really depends on how long you've been a customer, what the person on the phone had for breakfast, the direction of the wind, etc.
