Actually, after I believe 2006, all cell phones microphones are able to be turned on and off, by the so called law enforcement agencies of the federal, and state governments. That is phones manufactured from 06, or 07 on. They can turn them on and listen to what is being said at any time, as long as there is signal to give them access to the phone. Even if the phone is powered off. The only way to stop the access, is to remove the battery. I saw this on the news a couple years ago. It's to "fight terrorism", of course.
