Up button on D-Pad not working correctly

The "up" button on the d-pad of my Mogul just started acting wierd last week. Every time the up button is pushed, it acts like I am pressing the middle of the d-pad (the select or enter function). If the phone is in landscape mode, the same button (which turns into the "right" function) displays this behavior. This just started randomly, as I have not installed anything new on my phone in a while. It has been working fine since I got it (since early July 07). I have tried a couple soft resets, which has not yielded any results. Any ideas of what would cause this? I am just hoping it isn't a hardware issue that has popped up.

I am running firmware 2.08.651.4 (original) with radio 1.32.00.

Software installed:
Microsoft Live Search
Google Maps
HTC X-Button 1.5
HTC Home Plugin
Resco Explorer
Opera Mini

I have read that this happens and its a hardware fault. Take it back, you should have a 1 yr warranty on the phone.
