You won't get in trouble by selling/trading a refurb that just gets to you as long as it has a clean ESN that makes it capable of being active. And if you want something like a Diamond (which my girlfriend has 2 of), you'll have to add on a reasonable amount of extras with it.

well i got the new replacement today and i just sold it on craigslsit. i also just bought a treo 800w. i couldn't afford a diamond or touch pro but i think i should be happy.
