I can confirm this. I took my wifes mogul in on saturday and they had to order her a brand new one since they had no refurbs. Came in today.

Definitely the case.. Took mine in Saturday for a d-pad problem, and received a brand new one today!!

Mine is messed up as well but im gonna wait to use it for swap for the touch pro.
