Too bad. Arguably he stole it, since it didn't belong to him and then sold it.

But, the Apple dev who left it should be partially liable.

its funny, he called apple and tried to give back the phone, but it seemed nobody cared till after it was published then he had apple guys at his building asking to search his house.
