The Groove ROM has April Fools all over it, im calling thats the case for his ROM's being removed. At least I hope so

I don't think anyone should worry about it. From Microsoft's view, cooked roms are not hurting their business at all. Most people are locked with their phone for the 2 or 3 years anyway, and they're trying to make the experience better. People have already bought the phones, and it's not like they sell different versions of the roms. We're not pirating the OS.

The only thing they would be worried about is leaks of 6.5, because they want some anticipation I guess. They would also want people to update their hardware, but then again they said they are allowing hardware manufactuers to give out updates to 6.5.

I really don't think Microsoft has any good reasons to outlaw cooking. They even said that WinMo's malleability is one of it's advantages over other OSs (which I totally agree).

Downloading it is technically not illegal (very limited copying claim which most courts discount) however using it on your phone is more likely to be considered a violation of copyright. Now for a 6.1 ROM you have a license for the software (which was included when you bought the phone.)

Thus you are allowed to copy make copies as required for use. Arguably this includes loading a ROM as it is essentially the same as hard resetting.

However for 6.5 you do not have a license and therefore are making illegal copies every time you install it/run it on your device.

Will MS go after you? VERY VERY unlikely. Quite simply it is not worth their time/money. Plus it raises complicated legal issues they don't want to risk bringing to court over a simple copyright infringement claim.

Will MS go after a distributor? Still unlikely but possible as it enables widespread copying and thus could be sued for 150k per offense which adds up quickly (see any RIAA lawsuit.) Put simply they rely on distributors' fears of being party to a multi-million dollar lawsuit (which is why cease and desist letter usually work.)

Agree completely. If WinMo didn't have cooked ROMs I would probably be on another OS. To your point about upgrading, I think they want you to buy new hardware (ie a new phone) which helps both MS and HTC rather then updating your old phone to the new OS.

It does. It's just that with the DIAM100's mtype, the fix isn't applied, and with the DIAM500's mtype, it doesn't boot.

I had to hack around it to get it to work.
