I think he is implying that the phone will show up in their system as shipped/sold to the OP at some point and at that point they WILL charge his account. So, either Sprint gets their $300 phone back or they get $300.

They might have screwed up for now. But trust me man, Sprint does some shady things and charges will appear out of nowhere. Just when you think your good.....BAM....they charge you.

Exactly, that's why I say let Sprint know about the mistake and you never know it might work in your favor later.


I'm just surprised one of our benevolent mods would tell the OP to sell it and not do the right thing and give it back.

I think you need to call them and send it back. As others have mentioned Karma is a bitch. I do think Sprint will catch the mistake eventually and then you will have quite the dilemma on your hands.

lol, someone did screw up, and the op is going to add to it by not returning the phone. every esn is tracked, sprint will bill them in a month for the phone. you've been here as long as me, when has someone posted that sprint just mailed them a phone and they never paid.....?

He wasn't telling him not to do the right thing, he was simply saying, either way the OP is going to pay for the phone so if he wants to sell it he can. The difference is this, the first few responses were reccommending the OP sell the phone because they thought he was getting over on Sprint, whereas WarChild, recognizing that the phone will be tracked and charged to his account, suggested that he sell the phone because he IS going to be charged for it if he keeps it and in which case it would be his property.

WarChild, let me know if I'm off base.

Err no. If you didn't order something and a company sends it to you, the FTC says it's yours. If the OP really didn't order a phone from Sprint, then according to this post:

It's his to keep. "Karma" has nothing to do with it. Legally he isn't obligated to return it unless he actually ordered it. It gets awfully frustrating reading about people's subservience to companies on this site. First installing software on your phone voids your warranty, now you've got to go out of your way to give Sprint back a product you aren't legally responsible to return to them? ROFL. If you make a mistake and ship Sprint something you weren't supposed to, good luck getting it back. If they do, somehow they have a right to charge you? I. Don't. Think. So... and neither does the FTC.

Why return it ? Do the right thing ? oh please, money is money. sell it on eBay. Think about it this way, if you keep it, and they do charge you for it, you'll still end up making money in the end. They'll charge you around 300 right? oh well. I just sold a touch pro 2 for 250$. I know for sure you can definitely get an easy 450$ for the evo on eBay at the moment. even more if you sell to international buyers.

I just seen 2 of them go for 550$ at a buy it now price. I would love if they sent me an extra one. mine shipped today, should be here in the morning.
