Unlucky!

I've had my Diamond that Asurion sent for my Touch for less than 2 weeks. I stood in disbelief when it fell from the counter into the infant bathtub my wife left filled up near our bathroom counter last night. I removed the Battery and let it dry overnight. Powered it up in the morning and it was on constant vibrate. Dried it out better at work and it booted a few times and then was just DEAD. I called Asurion and told them the phone had quit working. They said they would send out a replacement, but didn't mention the $50 deductable like they did the first time. Well, after playing with the phone for a while, flashing the Sprint Rom, losing Internal memory, hotfix to recover memory, etc. The phone seems to be working fine now! I have Another replacement on the way, but not sure if I will be charged the $50, not sure if I should just send it back and keep the 2nd new one or what?
Not looking to defraud the insurance company, but wouldn't mind having a backup. The paperwork says you "may" be charged up to $300 for not returning the damaged phone. Anyone have experience not sending the phone back, and whether or not you were charged $300. Thanks for any input!
