Yes, if they find out you still have it you're liable for a like $250 charge or something of that nature. If you're not willing to keep it as a non-cell tower working phone it is best to just send it back in.

I just got off the phone with Assurion and man that Insurance company is a pain in the a** to deal with. As noted earlier in the thread I cracked the screen on my mogul a few weeks back. Calling Assurion I was told the Mogul was on a 7-10 backorder, but I hoped on the Mogul still over the Diamond and other offerings (I really like the Mogul).
When I got back into Philly I had a Mogul waiting on me. It shipped the next day. I was happy. Until I examined the Mogul... It came with a busted keyboard and a broken SD slot... A quick call to Assurion got me the same song and dance, except this time the Mogul was on "Indefinite Backorder". I told them a Diamond was nuts and I'm not taking a downgrade so I was told to take it to the Sprint repair center.
At the Sprint Repair Center they took one look at the phone and were like "that's bad" (the Keyboard) and I was told I had to take it up with Assurion as it was within the first 30 days. I told them Assurion and trying to push me the Diamond and I was told that's not what they were supposed to be doing. I called Assurion from the Sprint store prepared to put the Sprint tech on the phone if Assurion starts with the same song and dance, but they didn't. After I explained the problem again and mentioned the statement from Sprint I was told "I see the last rep. offered you the Diamond and 800W. I am pleased to say we can now offer you the Touch Pro". So I took that...
Is Assurion just pushing Diamonds on us initially to save money? Hoping we'll bite that first since it is "new"...
