I've heard this a few times, but nobody ever tells me which law is being broken. You could certainly do similar things if your purpose was moving a GSM phone between providers. Is there a special CDMA law?
Also note that switching providers, GSM or otherwise, doesn't change the ESN. As noted, it is supposed to be part of the firmware and unchangeable.
The fact that there are methods to get around this doesn't mean that it's supposed to happen.
