Points to keep in mind:

1. If you are on your 1st handset still, dont even bother.
2. Do not contact Customer Service because they will not and can not give you the TP2
3. When you go to a store (mainly a authorized repair center), do not mention what you read or even anything you know. Go in asking for the same phone and dont budge
4. Be nice!
5. As mentioned in step 3, do not mention any research you have done, and site you saw it on etc...
6. As we all know the downfalls of the phone and if you are going to fib a little, make sure its things that are consistent with what is universally known (experienced 1st hand, not known by just reading) such as poor battery life, overheating, faulty keyboard. In other words, things that they cant fix by reflashing the phone.
7. Be nice
8. And finally, share your experience with us so we can all read about as many instances as possible
The only one I see a problem with is number 2. I was still on my first TP but I think it had to do with my particular situation on why I was able to get mine. It maybe harder for people on their first TP to get a TP2 but it is possible. It is just up to the stores discretion. I agree with everything else you said though.
