Problem with battery

I've been having problems lately with my Touch Pro. When I start the phone up the battery life icon looks like this: [ !] . When I go to power under Settings > System it says the battery life is "Unknown". When I plug in the charger it does nothing (same with PC USB). I've tried soft reset and hard resets. Sometimes when I boot the phone up with it plugged either via PC or the charger it works. As in it tells me the battery life and works when I plug it in. Sounds like a hardware problem but I'm not sure. Any ideas?

Sounds like the battery driver. What ROM are you running?

Currently I'm using the Just Works ROM posted on this site. The problem began with the original ROM. It continues with the new ROM.

Oh, I guess it possibly could be a hardware issue. Can you try another battery?

No, I don't have another battery to test it. I figured out today that if I hit the reset button on the bottom with the phone plugged in via my PC the battery is fine. However, if I reset it with the regular charger plugged in it still gives me problems. Also, if the battery is acting up like I've described previously the phone won't charge or sync to the computer.
