cant activate it due to the person who had it before me never got it disconnected what can i do to resolve this issue

Contact the person who last had it, chances are he/she had a balance left over in that case you might not be able to activate it. The ESN can get banned that way, then it will never be able to be activated.

that means that the phone is showing in sprint's system as still in use on the previous owner's account. try contacting the previous owner to see what's going on with the phone and have him deactivate it on his account.
