They know you are not going anywhere....i think what you can do is tell ecare you took the phone to store 100 times already but they are not able to fix it. require them exchange with same model again and again..sooner or later they will give you what you want..haha

Like I said earlier I've been with em 8 years.

This one's extremely easy to get around. Just respond back with the fact that you spoke to a rep about the problems and researched them online and found that your device isn't malfunctioning, these are known common issues. They're design flaws that have still not been resolved via software updates, and with the Touch Pro on the way, there will be no more updates. Work from that.

I've had mine since november of last year.

Dear Sprint

I've had my mogul for some months now and have had numerous problems with it. It has been replaced and fixed mulitiple times and thing continually keep malfunctioning with it. On top of that the bluetooth is very poor and phone is slow to respond at times.

Should I say I know the touch pro is coming out and suggest them replacing the mogul with that ? Or is that too forward and sure fail?

You could call Asurion after the Touch Pro comes out. That's how I went from the 6700 to the 6800.

I just sent them an email last night. Here is the reply I received from them this morning.

Thank you for contacting Sprint. I am sorry for the inconvenience you
have experienced due to the handset problem.

As stated in the last interaction by previous representatives that the
handset is still under the manufacturing warranty. Therefore, I would
suggest you to please purchase the Touch PRO handset at the nearest
Sprint Store and we will send the return kit for the HTC Mogul through
e-care. Once this handset is returned to the warehouse the account will
be credited for the handset price. This way you will be charged only
the price difference of the handset.

The account will be credited for the handset in 1 to 2 billing cycle.
However, I would suggest you to please provide us the Tracking Number of
the returned handset and we will apply the credit of the handset through
e-care.

In addition to this, I can offer you additional $50.00 credit from my
side on handset upgrade. So, you need to purchase the handset at the
Sprint Store and after activating it just replay and we will apply the
$150.00 ($100.00 previous promised +$50.00 promised now) credit on the
account.
