8 Months later. can I return HTC Touch Pro?

I got a lot of problems with it lagging and just acting really goofy. Also the screen is all oil like.

However, I did drop it the first day I got it. Not from high up but it scrapped the pavement and has a few scratches and dings. Can I return it through that online program for another one?
