Yup. New phone for sure. However, it has to be within ONE YEAR not 30 days, regardless of TEP or not.
Manufacturers defect.

My screen went bad as well, 2 days after having phone. Went to repair store, told them the screen was fading on only the bottom half, took my phone, saw it, grabbed a new one and transferred contacts right away, didn't even say anything. I even completely forgot and had to go back for my sd card, so now I got 2.
