Yes, that is contract law. Oral or written, they have to perform what they offered.

Just called retention's they are escalating it but it doesnt look good for me :(

Ouch, that sucks. But I had to pay full price (well, 2-year contract that renewed my 1250 SERO though) which came to $428. About to sell my Mogul today for $170 though, and then I have to wait for my $100 mail-in rebate to come back, so in the end, it'll only be $158 down the hole. :)

my advice - be patient with them. I was trying to get my 6700 upgraded to a Mogul after 2 bad replacements. It didn't work so they sent me a 3rd, then 4th replacement 6700. the 4th one actually sparked and started smoking as soon as I put the battery in and powered it up. They then replaced it with a brand new Touch Pro... for free. Oh - and yes, they took back a phone replacement offer one time as well. I got my deal through advanced tech support.

File a complaint with the Better Business Bureau. That worked for me when I had several issues with sprint before. You can file a complaint via their website at www.bbbonline.org Sprint will always cooperate when you have a complaint filed against them.

I got a similar call after an email offer. I simply told him that I had a long string of e-mails showing that I had been promised a Diamond in return for my Touch. He asked me to forward them to him. He called me back 2 minutes later and said that they were going to have to abide by the offer I had been given and he would just have to figure out a way to make it work. He had offered for me to pay full price for the Diamond and then I would get a credit on my bill for the Touch when it was returned. I told him that I didn't want to in effect prepay my bill for that large an amount and then I told him about the e-mail's that I had. I now have a nice shiny new Diamond because I had the e-mail proof.
