Regardless of the build and hardware issues, the biggest issue on this phone is overheating. I would actually consider it a defect.

Seeing as it is a PHONE, and if I'm not mistake Sprint does REQUIRE data plans on their smartphones, it fails on both ends. It can't be used as either, without dying. EVERY Touch Pro does not charge while doing either. Sure I could put a fan by it, or stick it out the window, or put a bag of ice under it, by why in the world should I have to do that?

I've never had a cell phone that I couldn't charge and use at the same time. And like I said, I consider this a defect. I need a phone that I can use for more than 30 minutes, or surf the net for more than an hour. I don't recall them advertising the talk time as 30 minutes.

If you purchased a laptop, that wouldn't charge while you used you, I'm sure you'd want a refund or a replacement as well. And when you got that replacement and it did the same thing, I bet you'd want a different one.

So in regards to getting a different device, they damn well should give them out. There is no fix around this heat issue, and it makes the practically useless in the aspects which it's supposed to be: a phone.

Never try to get this upgrade within 1-2 months of a phone's release. The reps know you want the latest greatest and will avoid giving it to you. It's also not the best business practice since they don't even have any refurbs to send, just new retail boxes.

Lastly, if you truly feel that you are STUCK, get the refurbished replacement and sell it on ebay or craigslist as suggested. I don't know what number you had in mind for a credit, but I think you would get more this way anyway.


Currently work for Sprint. This would get you more help. People who come in acting like A-holes, you likely to get nothing. You come in, like this, and just let us go through our spill, it's whatever. Aint our money. But if you treat us like less than human, you'll just be a mad soul, without a phone!!!

Lack of consumer research, seems to be most Sprint users problems. Wait until the durn phone comes out, check forums, then buy the phone. It'll cut down on many problems, I promise.

How many before you realize that you need a new carrier, rather than a new device. The thing with the refurbs, no one checks em. I get customers, who have other customers contacts, pictures, personal information on their brand new refurb. You owe yourself, a new carrier. Anybody remember all the issues with Sprint Mogul. Customers getting 6 or 7 replacements, due to bad refurbs. Same thing with the Touch Pro, now.

I agree. I was going to say exactly the same thing but I was on my phone and didn't feel like typing all that last night. If the same thing happens over and over, don't expect Sprint to finally change. Sometimes you need to say all right that is enough I'm switching.

And there is an "Earpiece speaker buzzing" thread. Looks like people are already switching out units right when they get them. Have fun pushing for an upgrade and then asking for a replacement phone already.

What about the COUNTLESS individuals that have NOT had problems with the Moguls and are still working fine?

Myself included... 2+ years and counting.

I've had my mogul since just after launch. My first one, never had a real problem until recently when some of the keys are getting tough to register. However, thats not the phones fault, I work in construction and repair, and I've never cleaned the phone out.
