Earpiece doesnt work unless some one calls... what's up?

Lately my phone wont pass audio through the earpiece when I place calls, it works via speaker phone, and sometimes snaps back in and works when I switch back. Mostly someone has to call me for the earpiece to work.

I thought it was a rom thing, and flashed and reflashed. Still happening. I cant figure this out.

Any thoughts. I am on Energy now, was on Mighty previously.
