I'd say more safe than not. Like others have said, pay using paypal. I've had them come through twice already.

I bought mine from Verizon, but just some advice. A person can have 100% feedback, but only buying feedback. If you see they are selling 10 different phones, all new, and they have no feedback from buyers (or any feedback from cell phone sales), be cautious.

Like others have said.. as long as you can verify that the phone you are getting has a clean ESN.
I have had people call in to activate phones and when I go to swap the ESN , if it is flagged for stolen the person is SOL. That always sucks for the customer |

Two times in the past year I have received calls from Sprint because someone called to verify an ESN that they were looking to purchase on eBay - but those ESN's were my phones.
At first I wouldn't even talk to Sprint because someone called me and could've spoofed the number, so I had them walk me to through their site to see the number I can call them back at and then be transferred back to them. It was someone within the smartphone activations team. After the second call I told them I was concerned and they apologized for the worry and "for being cool about it" offered me an extra 1000 minutes/month for life. Well I have a 1500 minutes share plan that now only uses 200 minutes because of AnyMobile. So I told them to apply it to my fathers old 200 minute 20$ legacy plan because he would never answer his phone in fear of using his minutes. So, don't know if this is the kind of experiences you were asking for but hope it helps. |

If you check the seller's history and feedback you are usually fine. Even if they have never sold a phone before it's pretty much irrelevant if they have a long history of great feedback. They may have "upgraded" and then decided to the sell the phone. For example, I bought three TP2s for $200 each and sold two of them on ebay. I stated that the phones were purchase new directly from Sprint. No one ever asked me for ESNs and my buyers are happy.

read the feedback always buy it from seller who has more than 1 listing of the same phone.

Paypal is now set up to hold the money you intend to pay them until you leave POSITIVE feedback or if a month has passed and you have not left feedback. If you are not satisfied with the phone, you can contact paypal who inturn will contact the seller and arrange to send it back. Once a tracking number is obtained thru paypal (signature confirmation of course), paypal will release the money back to your account when the seller has received and signed off on the item. HTH!!

This is a very useful thread, almost should be stickied. I am still hesitating about getting one but now the prices are dropping on eBay so they are lower than Sprint and there is no contract etc...
I assume that if you activate a phone bought on eBay with your current Sprint number, you just continue with the current plan and costs. I have a very low rate due to an employer deal.
