Wifi always on after Soft Reset

Every since i have flashed to the new 3.16 ROM when i soft reset or turn my Mogul off and turn it back on, wifi is turned on even if the switch is set at off, and i have to use the Comm Manager to turn it off moving the switch on and off doesnt do it, but after its off its works fine in sync with the wifi switch, does anyone else notice this? Or know a way i can stop it. Thanks.
