I'm not sure what you're attempting to draw?
The clause stating they will turn over information to law enforcement is standard fare in any online privacy policy and required by law in some jurisdictions. They would require the law enforcement agency to show a court order to obtain that information. I'm sure Microsoft really doesn't care too much about how many people are cooking roms and running them. It can be argued that cooking ROMs is to some degree piracy, but that's not a direct argument either. Since Windows Mobile isn't purchased at retail, but is only sold in devices. Microsoft also doesn't support Windows Mobile directly they let the OEM and Carrier shoulder that burden. Those make me think Microsoft could really care less if we run cooked ROMs on our phones. They have little to loose. HTC (et. al.) and Carriers are another story. I'm sure they'd want us to stop using any cooked ROMs at all.
