Yes you have to pay even if the app will be free... It is fair as the app has to undergo testing and code signing to be put into the app store. Not QA testing, but testing to be sure it meets the WinMo guidelines.

For pay apps $99 a year investments aren't much. If your app doesn't earn more than $99 in a year you probably should just drop it in place of another app.
