The Cease and Desist seems to go against M$ statement a few weeks ago, where they claimed the roms weren't their property but belonged to the company that bought the software(HTC):

It would also seems that TSOwen has a contact at the antipiracy division of MS that you may want to get ahold of to find out if the action is in fact legit.
