No, they'd give you a working used battery from the ones they keep when they do returns. Obviously, since you only had your phone for 2 days, that wouldn't be acceptable.

Are you saying you get no heat at all when charging? How about on a long phone call, any heat at all? Because that's pretty much the only problem I've seen with the phone.
