Filing an insurance claim does not extend your upgrade eligibility..
As far as the Touch is concerned, once it hits it's end of life (no more new or refurbs left), only then will they be replaced with the Diamond. Some people are able to get the Diamond upgrade via a claim, but it is a hit or miss..
My claim replaced me with another Touch two weeks ago, only Asurion sent me a refurb touch that was already activated on another account. Because I couldn't get it activated, they sent me a Diamond as an apology. As far as I know, there are still a few more Touch's out there.
