So......the guy said he would send me a new Touch Pro. I just find it hard to believe. I hope I am not disappointed and open the box and find a refurbed Mogul. I guess if they say it, it must be true?????

Wait for the e-mail verifying shipment, it will contain the information telling you what device is in the box, along with its serial number.
