I love Ebay, have bought and sold many phones that way.
Strike up a conversation with the seller. If they don't answer or respond as you wish, don't buy it, there are others out there.
Second on Craigs List, that is where I got mine - brand new in box less than Sprint.
However, one of the other problems with Ebay buying and complaints - trying to buy a phone that doesn't work on your network - might be the buyer's fault, not the seller's!!!!!!
