You CAN answer the phone while DATA is ON for CDMA devices.

1. Navigate to HKLM\Comm\CommMgr\Planner\Settings\

2. Delete the following key: "SuspendResume"

3. Also add "CacheTime" value of 60 (if it didn't already existed)

3. Soft Reset the device

I can now answer calls while DATA is ON. It will Disconnect when idle for 60 seconds.
