My point is I think Bored and Scott shared a lot of the same base files (SYS XIP whatever I don't know enough about the details) and there is probably some common issue there...maybe it's a CE OS bug with that newer build, I don't know. Just offering what I have experienced.

I think that I can confirm what you are saying. With the ShutXP, when you hit "OFF", it just goes to "sleep" and not off because a "quick top on the POWER ON button brings the screen to life. If I remember correctly, if it was truly "OFF", you need to hold it for about 5 sec before it comes back on. Additionally, I had BATTLOG (current draw measurement) running, and when the screen came alive again, I could see that the current had never dropped to Zero. It continued to draw current, even when it should have been off (and it also should have shut down that program). An even more definitive test was I tried calling the phone (when it should have been totally off) and it "awoke" and rang. So the SHUTXP off is definitely not working....just lets it take a nap.
Edit: I'm using the Nav 3.0 ROM
