I had this problem too--I think it's a ROM issue. I had this problem on a few ROMs I used on my Touch as well.
The behavior you should expect is that it will update
once you open the weather tab--not before. Some ROMs on my Touch update in the background, but the one I am running now only seems to update once I open the tab.
