When you buy an item at a retail store and it fails in any way whatsoever right out of the box, do you look for ways to blame anyone other than the place that took your money.
When I sell anything on Ebay I understand I have to take liability to the goods sold or risk negative feedback as well as potential payment cancellations which paypal will auto-subtract back out of your account if someone thinks they got a bad deal.
btw- I love the Mogul...it's an amazing phone. Unfortunately it's got certain issues that are unsolevable. The IE isn't one of them...although they did choose to ship it with that despite it's limitations.
Regardless... opinions will vary significantly on any issues with any product in direct proportion to how much they paid for it. If it was given free to me, as some have stated they received it free, then sheesh who cares of whatever problems it has...but spend over $500 for it and the tune will change. Especially when you're told you can't exchange it, or get your money back, or even allow you to pay the difference between it and an upgrade.
This has already been explained a hundred times throughout this thread...so after this post I'm just going to let it die out.
