You won't have to spend $50. If you have TEP, then Sprint covers the manufacturer's warranty. All you have to do is walk into a Sprint Repair Center, and if they cannot fix it, they will give you a "new" one.
Most of the time, it's truly a new one, but they are allowed to give you a refurb. On all of my returns for all my sprint phones, I have always received a BNIB unit--regardless of purchase location/company, or time elapsed. I could go in right now and get my Touch replaced, assuming they still had stock. (They would possibly just give me a Diamond instead.)
