If it is not a Sprint phone and has a dialer that works with the ##Codes then it can be activated. But it always is in your best interest to flash back to OEM ROM. The carrier won't suspect anything if something should go worng. If the customer wants to upgrade after then that's his choice.

This is why I laugh at people on eBay selling Sprint phones with WM6/6.1 phone huge prices, and people buy them thinking they're a good deal. When in reality, it won't even be able to be activated...
