I had a similiar problem. I had 7 moguls in the past 9 months. This last time, the touchscreen completely died. The store I brought it too couldn't fix it (obviously) but didn't have any in stock to give me a new one. They had to order one, which they said would arrive in about a week.

At this point, I had had enough. It sucked in the past, but I was always able to get a new phone right away. I sent emails back and forth from ecare for a week, spent hours on the phone, and eventually the best they would agree to do is allow me to buy any phone at the new customer price. I chose the blackberry 8330... $100 new customer price, $569.99 MSRP. When I send back my mogul, they'll credit my account with $469.99... so I paid $100. I can then swap the blackberry out with any other phone and just pay the difference in MSRPs... so in the case of the Touch Pro, I'll pay $100 + $10 (difference in price).

It took a lot of work to get that deal though. They kept offering me $50, or $100 towards the purchase of any new phone... but I paid $300 for the damn mogul 9 months ago. I felt the same as you... why should I have to pay nearly full price for another phone, when the first one I bought less than a year ago hasn't worked properly the entire time ?

If they're willing to basically swap your mogul out for any new phone free, that's awesome. Congrats.
