i took a different approach, but I think my situation takes different merrit I will summarise
took phone into repair center got a refurb, refurb was bad, ordered a second refurn that was bad. 2 weeks of calling *2 getting noware, 16 e-mails to e-care giving a 50 dollar credit to get an asurion replacement. reading the terms of the warranty and finding out I was blatently lied to. called *2 lucked out and got florida. transfered to account services. getting sent a NIB mogul which is getting sold to my account then credited meaning my 30 day window will open up again in 2 days. so if the touch pro comes out by the 19th like we all think ill just have the pay the difference (30 bucks) if not ill just get the diamond. it pays dividends to read the contract your trying to invoke, it would have probably saved a large percent of hassle I went through after the repair center said they wouldnt repair/replace the last phone.
