Like I originally said, it's not the same. But it does have several simularities.
Still even if it is a hack job, look at how many people tried to hack HTC's Touchflo, and no one was even remotely close to successful on a device w/o 3D Acceleration (unless you call 1-3 fps sucessful...). To "hack" his rom took roughly 6-8 hours at least, so it wasn't even like it was that easy to hack his own rom. I can only imagine he put in a decent amount of time like yourself while working on it, so it was by far no easy task. It was still taken from him without any permission. While yes the name wasn't change, it's still stealing from his work w/o permission.

Actually Herg quit working on Hergila as soon as Manila 2D came out. Manila 2D is udK's original work at editing the HTC code, and was not part of Hergila. I saw this unfold as I tried using Hergila as soon as I saw Manila 2D being released in the rom, and I followed the whole development of it as it happened.
Herg said something along the lines of "I'll extract it out of the rom within the day..." unfortunatly Noonski deleted at least 40 pages worth of stuff, and he deleted herg's post that said that (if you search PPCGeeks, you will see references to his post #23, but when you go there post #23 is by someone else).
It seems the only tie Herg has with the current one is he did some early extraction, and he builds the cabs for everyone.
Now once AGAIN I am not defending NSFFan, all I am pointing out is this is another example of illegally stealing work, and this should be considered Warez. People are editing code that is not open source, and using it for their own benefit. Hell even udK is responsible for stealing software and editing it that is Copyright from HTC. But because HTC / udK hasn't contacted PPCGeeks about hosting it, it's completely ok.
