also it is a component of nueROM so it falls under any included license agreement there, the license clearly specifies commercial distribution is illegal, the license includes an attribution requirement.

Google nueusb, the first hit yields a thread with a link to nueusb zip file. I looked in the zip (again) and could find no license agreement or any references to who developed it. BTW, if you Google nueusb license you get nothing useful. Where can I find it, I'd like to take a look?
Maybe we're talking about different things. I didn't say the source code was released, I was referring to the package of executables. Didn't you make them available for inclusion in other people's roms? I'm not trying to piss you off, I'm asking because I honestly don't know.
