Oddly enough this bug has disappeared on the default ROM. Don't think I've received any updates. The only thing I did to the phone from when I posted this to now is the main page tweaks.
the bug is still there
i experience this on occasion.

especially last night when iwas testing Flash on the www.youtube.com (desktop page version) but guess what Flash works :P
